Mediating Disposition of the Family Residence & Retirement Assets

New Day Divorce has designed this online training to provide you with the fundamentals for mediating the disposition of the family residence and retirement assets.  The training will cover the following topics:  decisions to sell or keep the family residence, valuing the family residence, 2640 reimbursement, Moore/Marsden, creative options for buy outs and refinancing, IRA’s, 401k’s, traditional pensions, public pensions, valuation of IRA’s & 401k’s, actuarial valuations, characterization of separate and community interest in retirement assets, application of time rule valuation of retirement assets and QDROS.

Training will include review of templates for drafting settlement terms and conditions related to the disposition of the family residence and retirement assets,  consideration of basic tax consequences and collaborating with financial professionals.

This training will provide you with the skills and competence you need to confidently mediate the division of these major assets in the parties’ marital estate.  You will learn to ask the right questions, gather all the necessary information, and understand the fundamental legal rules that apply when mediating the disposition of the family residence and retirement assets in your divorce mediation cases.

Divorce 101 & Drafting Settlements

This first Online Mediation Training presented by New Day Divorce is designed to provide Family Dispute Resolution Professionals with the basic skills they need to mediate California divorce matters. Attorney mediators and non-attorney mediators, financial, mental health, real estate, coaching and other professionals will find this training indispensable as they prepare to tackle the legal issues that are most commonly presented when they mediate California divorces. Training participants will learn how to document divorce settlements to assure that their memorandum of understanding, and marital settlement agreements include all the necessary provisions for entry of judgment in California Superior Courts. For those participants who are licensed to prepare and submit legal documents, a Judgment template will be provided in digital form along with instructions and tips for completing Judicial Council forms necessary to obtain entry of uncontested or default judgments.

Terri Breer, Attorney and Mediator with over 35 years of experience in family law mediation will present this mediation training that has been one of the most popular in-person training programs and will be the first in the Essentials for California Divorce Mediators Series to be presented online.

The training will be in two parts:
Part 1 – Divorce 101: Introduction and review of family law statutes and basic legal rules for California Divorce cases that every mediator needs to know.
Part 2 – Drafting Settlements: Instruction on how to draft mediated settlements in a form suitable for filing in all California Superior Courts.
